CONSTITUTIONAL ENGINEERING IN THE 2017 THAI CONSTITUTION: ARTICLE-LEVEL MECHANISMS AND THE LIMITATION OF POPULAR SOVEREIGNTY

Abstract
This article critically examines constitutional engineering in the 2017 Constitution of Thailand, focusing on article-level mechanisms that constrain popular sovereignty. Employing a qualitative documentary analysis grounded in constitutionalism, representative democracy, and comparative constitutional engineering, the study finds that the 2017 Constitution systematically limits citizens’ political power through structural, procedural, and rights-based mechanisms.
The findings indicate that the appointed Senate, restrictive amendment procedures, and the transformation of rights into state obligations collectively weaken democratic participation. The Constitution reflects a “controlling constitutional design” rather than a democratic one. The study recommends institutional reforms to restore democratic legitimacy and popular sovereignty.
